1. Purpose

  • This Member Service Agreement (‘Agreement’) establishes the rights, responsibilities, and obligations of the AmeriCorps member (‘Member’) and [Organization Name] (‘Program’ or ‘Host Organization’) for the service term identified herein.

2. Scope

3. Definitions

    Where terms are not defined herein, the definitions in the National and Community Service Act of 1990, as amended (42 U.S.C. § 12501 et seq.), shall govern.

4. Service Term and Hour Requirements

6. Prohibited Activities

  • Per 45 CFR 2522.900, Members may NOT engage in the following activities while on duty, in uniform, or using AmeriCorps or program resources, regardless of whether the activity is otherwise legal:

    6.1 Absolute Prohibitions (apply at all times during service term)

    • Attempting to influence legislation (lobbying) as a substantial part of activities
    • Organizing or engaging in protests, petitions, boycotts, or strikes
    • Assisting, promoting, or deterring union organizing
    • Engaging in partisan political activities or working on behalf of any political candidate or party
    • Engaging in voter registration drives (note: voter registration is permitted only under specific conditions per 45 CFR 2522.900(a)(6))
    • Providing abortion services or referrals for abortion as a primary activity
    • Engaging in religious instruction, conducting worship services, or proselytizing
    • Using program funds or resources to support or oppose any religion
    • Participating in activities that pose a significant safety risk to participants or the public
    • Engaging in any activity that would constitute a conflict of interest under 2 CFR Part 200.318

    6.2 Prohibited While On Duty or in Uniform

    The Member acknowledges they have received, read, and understood the prohibited activities list. Violation of any prohibited activity restriction is grounds for immediate suspension or release for cause and may result in loss of the Education Award and referral to the AmeriCorps Office of Inspector General.

7. Living Allowance and Benefits

  • 7.1 Living Allowance

    Per 45 CFR 2522.240, the Member will receive a living allowance as follows:

    7.2 Segal AmeriCorps Education Award

    Upon successful completion of the service term (minimum required hours met, no release for cause), the Member is eligible for the Segal AmeriCorps Education Award per 42 U.S.C. § 12604:

    7.4 Childcare

    Members are covered under the Federal Employees’ Compensation Act (FECA, 5 U.S.C. § 8101 et seq.) for injuries sustained during service, administered through the U.S. Department of Labor. Members must report any service-related injury to their Site Supervisor within 24 hours and complete required FECA documentation.

    7.6 Student Loan Forbearance

    Members with qualifying federal student loans may request forbearance during the service term. Interest accrued during forbearance on qualifying loans may be partially paid upon successful completion of service. Members should contact their loan servicer directly.

    7.7 Benefits Not Provided

    The following benefits are not provided under this Agreement unless separately documented:

    • Unemployment insurance (Members are generally not eligible; see state-specific rules)
    • Retirement / pension benefits
    • Paid vacation (leave is unpaid and does not count toward service hours)
    • FMLA protections (note: Members are not employees; however, programs should consult counsel regarding state equivalents and ADA accommodation obligations)

8. Non-Discrimination and Equal Opportunity

    • Members who believe they have experienced discrimination may file a complaint with the AmeriCorps Office of Civil Rights and Inclusivity or the Equal Employment Opportunity Commission (EEOC) within applicable filing deadlines.
    • The Program prohibits harassment of any kind, including sexual harassment. Members who experience or witness harassment must report it to the Program Director or HR immediately. The Program will investigate all complaints promptly and in good faith.

    California Members: Per CA AB-1825 and CA Government Code § 12950.1, supervisors of California-based members must complete sexual harassment prevention training within 6 months of assuming supervisory duties and every 2 years thereafter.

    New York Members: Per NY Labor Law § 740 (whistleblower protections), members who report violations of law, rule, or regulation are protected from retaliation.

9. Grievance Procedure

  • Per 45 CFR 2540.230, the Program maintains a grievance procedure for Members. Members have the right to file a grievance regarding:

    • Alleged violations of this Agreement
    • Discrimination or harassment
    • Retaliation for protected activity
    • Disputes regarding release, suspension, or Education Award eligibility

    Step 1 — Informal Resolution (within 5 business days of incident):
    The Member should first attempt to resolve the concern informally with their Site Supervisor or Program Director.

    Step 2 — Formal Written Grievance (within 45 days of incident):
    If informal resolution fails, the Member may submit a written grievance to: [HR / Compliance Officer Name, Title, Email, Address]. The Program will acknowledge receipt within 5 business days and issue a written decision within 30 days.

    Step 3 — Mediation / Arbitration:
    If the grievance is not resolved at Step 2, either party may request mediation. Disputes involving the Education Award or termination of enrollment may be referred to AmeriCorps for resolution per 45 CFR 2540.230(b).

    Anti-Retaliation: Retaliation against a Member for filing a good-faith grievance is strictly prohibited and is itself grounds for disciplinary action against the retaliating party.

10. Roles and Responsibilities

  • 10.1 AmeriCorps Member

    • Complete the minimum required service hours within the service term
    • Serve in accordance with the position description and this Agreement
    • Record and certify service hours accurately and on time
    • Comply with all prohibited activity restrictions at all times while on duty or in uniform
    • Notify the Site Supervisor of any absence, injury, or concern promptly
    • Complete all required training
    • Maintain confidentiality of program participant information per applicable privacy laws
    • Report suspected fraud, waste, or abuse to the Program Director or AmeriCorps OIG Hotline (1-800-452-8210)

    10.2 Site Supervisor

    • Provide day-to-day supervision, mentorship, and performance feedback
    • Review and certify Member timesheets on a [weekly / bi-weekly] basis
    • Ensure Member service activities align with the approved position description
    • Immediately report any prohibited activity concerns or member misconduct to the Program Director
    • Complete required supervisor training per program requirements

    10.3 Program Director

    • Maintain compliant Member files including this signed Agreement, timesheets, training records, background check documentation, and any disciplinary records
    • Ensure living allowance payments are made on schedule
    • Submit required reports to AmeriCorps via eGrants or designated system
    • Administer the grievance procedure in good faith
    • Notify AmeriCorps of any Member exits (completion, release for cause, or suspension) within 30 days per grant requirements
    • Conduct annual policy review and update this Agreement as needed

    10.4 HR / Compliance Officer

    • Maintain records of all signed Agreements for a minimum of 3 years after the end of the grant period per 2 CFR § 200.334

11. Performance, Discipline, and Exit

  • 11.1 Performance Expectations

    Members are expected to serve diligently, professionally, and in accordance with this Agreement. The Program will provide feedback through:

    11.3 Release for Cause

    A Member released for cause is not eligible for the Segal AmeriCorps Education Award per 45 CFR 2522.230(b). Grounds for release for cause include but are not limited to:

    • Violation of prohibited activities under 45 CFR 2522.900
    • Falsification of timesheets or program records
    • Gross misconduct, criminal conduct, or conduct endangering others
    • Failure to meet minimum hour requirements due to unexcused absences
    • Repeated failure to comply with Program policies after documented warnings

    The Member will be notified in writing of a release for cause decision and has the right to grieve the decision per Section 9.

    11.4 Successful Completion

    Upon successful completion of the service term (minimum hours met, no release for cause), the Program Director will:

    1. Certify completion in eGrants or the designated AmeriCorps system within 30 days
    2. Provide the Member with a written confirmation of completion
    3. Ensure the Education Award is accessible through the My AmeriCorps portal
    4. Conduct an exit interview and complete the end-of-term evaluation

    11.5 Early Exit — Not for Cause

    A Member who exits early for compelling personal circumstances (e.g., medical, family emergency) may be eligible for a prorated Education Award if they have completed at least 15% of required hours and the Program Director approves the exit as not for cause, per 45 CFR 2522.230(a).

12. Confidentiality and Data Privacy

  • 12.1 Program Participant Confidentiality

    Members may have access to personally identifiable information (PII) of program participants, including minors. Members must:

    • Use participant information only for authorized service purposes
    • Not disclose participant PII to unauthorized parties
    • Follow the Program’s data security protocols
    • Report any suspected data breach to the Program Director immediately

    Applicable frameworks include the Privacy Act of 1974 (5 U.S.C. § 552a) (for federally funded programs), FERPA (20 U.S.C. § 1232g) (for education records), HIPAA (45 CFR Parts 160 and 164) (for health information where applicable), and applicable state privacy laws.

    California Members: The California Consumer Privacy Act (CCPA, Cal. Civ. Code § 1798.100 et seq.) may apply to participant data handled by California-based programs.

    12.2 Member Records

    The Program will maintain Member files containing this Agreement, timesheets, background check results, training records, and performance evaluations. These records are confidential and will not be disclosed except as required by law, grant oversight, or with the Member’s written consent. Records will be retained for a minimum of 3 years after the end of the grant period per 2 CFR § 200.334.

13. Exceptions

  • Exceptions to any provision of this Agreement must be:

    1. Requested in writing by the Member or Site Supervisor
    2. Reviewed and approved in writing by the Program Director
    3. Consistent with 45 CFR Part 2522, the grant award conditions, and applicable law
    4. Documented and retained in the Member’s file

    No oral exceptions or modifications to this Agreement are valid. AmeriCorps-mandated requirements (e.g., minimum hours, prohibited activities, background checks) cannot be waived by the Program under any circumstances.

14. Review and Revision

  • This Agreement and the underlying policy template will be reviewed annually prior to the start of each new service term, or sooner if:

    • AmeriCorps issues updated regulations, Mandatory Supplemental Information, or program guidance
    • Federal or state law changes affect member classification, benefits, or prohibited activities
